In recent years, the vaping industry has become increasingly competitive, with many companies vying for market share and striving to establish their brands. However, this has led to some legal disputes, with companies accusing each other of infringing on their trademarks or engaging in unfair business practices. One such case involves VPR Brands and the ELF BAR vape brand, which recently fell afoul of trademark disputes. VPR Brands is a little-known vape company that sells a 510-cart vaporizer named ELF and has had trademarks in effect and used ELF branding in conjunction with their device since 2017. ELFBAR, probably the biggest-selling disposable vape brand in the world.
VPR was able to demonstrate through trademark filings that they have the legal right to the name ELF, and that Elf Bar Disposables were confusing VPR’s ELF customers. VPR is also suing several U.S. master distributors of ELFBAR products. A master distributor is authorized to receive products directly from the manufacturer, and then resells to other distributors. Some of them also sell directly to retailers and some directly to the public.
Judge Cannon from the United States District Court for the Southern District of Florida issued an Order granting VPR’s motion for a preliminary injunction in the ongoing trademark infringement dispute over the “Elf” name. ELF BAR trade mark lawsuit fell and re-named EBDesign in US.
US consumers should be very cautious about ELF BAR products sold in retail stores. As legitimate ELFBAR imports have stopped, and distributors have almost no stock on hand. The company will now be known as EBDesign in US.
